1. ACCEPTANCE OF TERMS

By using Waymarker, you:

• Confirm you've read and agree to these Terms and our Privacy Policy
• Represent that you are at least 13 years old and legally able to form a contract

2. SERVICE DESCRIPTION

Waymarker is a personal journey tracking application that lets you:

• Document personal journeys with customized details
• Create waypoints with descriptions, sentiments, and impact levels
• Visualize and analyze your journeys
• Store data locally and optionally sync across devices

3. USER ACCOUNTS

Local Usage:

You can use Waymarker without an account, with data stored only on your device

Cloud Sync:

Creating an account enables backup and multi-device synchronization

Account Security:

You're responsible for maintaining your account security and all activities under your account

4. USER CONTENT

Ownership:

You retain ownership of all content you create in Waymarker

License:

You grant us a limited license to store and process your content solely to provide the service

Responsibility:

You're responsible for ensuring your content doesn't violate any laws or third-party rights

5. DATA STORAGE AND SYNCHRONIZATION

Local Storage:

Without an account, data remains on your device only

Cloud Sync:

With an account, data is securely stored on our servers

Data Deletion:

You can delete your data at any time through the app

6. INTELLECTUAL PROPERTY

The App, including its design, code, and content (excluding your User Content), is owned by Timeside, LLC and protected by intellectual property laws. You may not modify, reverse engineer, or create derivative works based on the App.

7. ACCEPTABLE USE

You agree to use Waymarker only for lawful purposes and not to:

• Violate any applicable laws
• Attempt to interfere with the App's operation
• Gain unauthorized access to the service
• Transmit harmful code

8. APP MODIFICATION AND PRICING

• We may modify or discontinue features with reasonable notice
• Waymarker is currently free, but we may introduce paid features in the future
• Any changes to pricing will be communicated clearly in advance

9. TERMINATION

By You:

You may terminate by uninstalling the App or deleting your account

By Us:

We may suspend or terminate your access for Terms violations or extended inactivity

Effect:

Upon termination, your right to use the App ceases and we will delete your account data within 30 days

10. DISCLAIMERS AND LIMITATIONS

As Is Service:

The App is provided "as is" without warranties of any kind

Limitation of Liability:

Our liability is limited to the maximum extent permitted by law, not to exceed $50 for free users

11. GOVERNING LAW AND DISPUTES

Disputes will be resolved through binding arbitration in Sacramento, California, under California law. Small claims court actions are excepted.

12. CHANGES TO TERMS

We may update these Terms periodically. Continued use after changes constitutes acceptance of the new Terms.
